Short Term Residence Permit

Short term residence permits have been organised according to the Foreigner ve International Protection Law, number 6458, article 31 and 33. Also, has been organised according to the Foreigner and International Protection Law Reference Guide articles 28 and 29.

Which Foreigner can attain a Short Term Residence Permit?

  • Those who apply for the purpose of research;

Those making applications for residence permits based on the basis or research, and have permission to do so, must provide relevant evidencial  documents from the relevant departments (Ministry of CUlture and Tourism, Ministry of Energy, Universities etc) to attain permisson; if they do not require permission then a declaration stating purpose of reseacrh must be supplied.

  • Foreigners who have real estate;

Those who apply for residence permit and own real estate must use the real estate for purposes of dwelling. Also family members must have financial shares or joint ownership to the particular real estate and then in this case can apply for a family residence permit.

  • Foreigners who have business alliances or intend to start a business;

Foreigners who have business alliances or intend to start a business, can apply for a three month residence permit, however must provide details of business alliances/companies or a letter of invitation and relevant documents.

  • Foreigners who will attend On-the-job training training;

Residence permits granted for these purposes require documents pertaining to the regarding institute’s cirriculum, period of training, place, time etc and permits will be organised according to this information.

  • Foreigners who apply for the purpose of student exchange programs or similiar purposes to educational institues that have an angreement with the Republic of Turkey;

Foreigners who apply for residence permits under these purposes must supply relevant documents from the institution to which they will attend.

Residence permit may not exceed the duration of the purpose of education or the likes.

Those to come within the scopes of student exchange programs (Erasmus, Mevlana, Farabi etc)and apply for general health insurance will not be required to attain any other health insurance. However, if students to not apply for general health insurance from the time of their application they will lose their right to general health insurance and must attain private health insurance instead.

  • Foreigners who stay for the purpose of tourism;

Foreigners who apply for residence permits under these purposes must supply relevant documents in regards to their travel plans (where they will travel within the country, when and how long they will stay etc). If required must sumbit required documents and information.

  • Foreigners who are carry illnesses that qualify as a threat to public safety and on the condition that they will seek treatment;

Foreigners to come to Turkey with this purpose will seek admission to public or private hospitals. Providing relevant documents that full payment of treatment will be covered through private health insurance.

Residence permits will be organised forthe duration of the treatment.

Throughout the duration of the treatment for those those whose expenses; for food, housing, health etc., that will be paid by public institutions or other agencies, and providing that they can provide relevant documentation, will not be required to attain health insurance.

When necessary, the applicant must provide; from the relevant hospital institution, document or feedback about the treatment.

Under the current Health Coorperation agreements scope foreigners who bring carer/s for the duration of the treatment (if under the agreement there are no provision for caretakers) then residence permits will be assesed according to the general provisions.

Also according to the Health Services Constitutive Law, numner 3359 supplement article 14, foreigners who come to the country fort his purpose are allowed no more than two people and caretakers who apply for residence permits are required to have health insurance.

8-Foreigners who are required tos tay in Turkey based on the decisions of judicial or administrative authorities;

Residence permits organised for this purpose will be processed in accordance to the specified statement/s from authorties.

9-For those foreigners who have lost their conditions to attain a family residence permit will be granted a short term residence permit;

10- For foreigners who will attend courses to learn Turkish;

For those applying for this type of residence permit and has enrolled into a course and attained permission from the relevant department (Ministry of Education) will be granted a permit no more than two times.

If the course duration is less than one year the permit will not exceed this period. The institution that is providing the course must supply the provinsial directorate of the foreigners course start date and period of education.

11- Those foreigners providing educational services, reseacrh, internship or courses in Turkey thru public enterprises;

Residence permits, organised with this purpose, can not exceed one year. Throughout the duration of the stay expenses; for food, housing, health etc., that will be paid by public institutions or other agencies, and providing that they can provide relevant documentation, will not be required to attain health insurance. Further information may be requested from the institution.

12- For foreigners who have completed their higher education in Turkey and have made an application within six months of graducation;

Those who apply for residence permits with purpose must make their application within six months of graduating and for one time only may be granted a one year residence permit.

13-For foreigners who do not work in Turkey; however makes investments in the amount and capacity specified by the council of ministers, and who foreign spouse, and their dependent child of minor age or any dependent chid; Those applying based on this reason may be granted no more than five year residence permits.

According to the International Labor Law; Law number 6458 and the amendments brought forth to encourage foreigners who have the quality to contribute to the economy of the country and ease the process and application of applicants who fit this criteria.

14-Those foreigners who are citizens of North Cyprus; Foreigners who make applications based on this conditions will be granted no more than five year residence permits at a time.

How often can short term residence permits be organised? Short term residence permits, excluding foreigners as those stated above in numbers 13 and 14, will be organised for no longer than two years each time.

What are the conditions for short term residence permits?

For short term residence permits to be organised foreigners must adhere to article 32 of the Law.

-Providing documents and relevant information for the purpose of their stay,

-Not be in the scope of article 7 of the Law,

-To posses general standards of health and security for housing,

In the event that it is requested, a civil registry or citizenship documents and a criminal record from the relevant authorities of the country they are a citizen of.

-Address details of place of residency in Turkey.

What are the reasons for the Rejection, Cancellation or Non-Extension of  Family Residence Permit?

-Conditions of family residence permits not being meet, or becoming obsolete,

-The detection that fthe family residence permit is being used for purposes outside of the reasons it was given,

-In the case that a verdict of applicant’s deportation or prohibition of entry into the country is found, then family residence permit will not be granted; if already granted will be cancelled, if permit has expired it will not be renewed.

-Offer being dropped because of the period of stay abroad; in these cases short term residence permits will not be permitted, if granted will be cancelled, if expired will not be renewed.

 

Family Residence Permit

Family residence permits have been organised according to the Foreign and International Protection Law, articles 34 and 37.Also the Implemenation of Foreign and International Protection Law Regulations have been regulated in article 30 and 34 of the Manuel.

Which Foreigners can Family Residence Permits be Organised for?

Those who are within the scope of the Turkish Citezenship Law number 5901, article 28, or foreigners who hold one of any residence permits and refugees and those who are protected by the secondary statute;

  1. Foreign spouse,
  2. Their own or their spouse’s minor foreign child,
  3. Their own or their spouse’s dependent child,

Family Residence permits can be organised.

In the event that foreigners who apply for family residence permitand have more than one spouse, only one of the spouse will be granted a family residence permit. However, all of the applicant’s children will be granted a familt residence permit.

For children family residence permit requests who have applications outside of our country then consent of both parents must be attained.

A family residence permit allows a child to the right of education, primary and middle school up to the age of eigthteen years, without a student residence permit.

Foreigners who hold a family residence permit may apply for a short term residence permit:

-In the case of divorce for those who are married to a Turkish citizen and have stayed in the country for at least three years, (only for foreigners that can provide evidence of a court verdict that they have been exposed to family violence and have held a family residence permit for at least three years.)

-For those who have stayed in the country for at least three years on a family residence permit and whose sponsor has died,

– For those who have stayed in the country for at least three years on a family residence permit and have turned eighteen years of age.

How often do Family Residence Permits need to be organised?

-Family residence permits must organised every three years without exceeding the expiry date.

-Family residence permits can in no way exceed the period of the sponsor’s residence permit.

-Meeting the Requirmed qualifications to be a Sponsor,

(The sponsor must; attain health insurance for all family members, have a salary of one third of minimum wage per family member, must not have any criminal record in relations to family violence and must document this, must have lived in Turkey for at least one year and be registered to the local civil registry.)

-Meeting the Requirmed Qualifications as a Family member living with the sponsor and applying for a family residence permit,

(Must present relevant documentaion as to the purpose of their stay in the country and provide evidence as to whom they are living with, or intent to live with, applicant’s spouse must be of at least eightenn years of age, must not fall into the scope of article number 7 of the Law, marriage must not be fort he purpose of attaining a family residence permit).

What are the reasons for the Rejection, Cancellation or Non-Extension of  Family Residence Permit?

-Conditions of family residence permits not being meet, or becoming obsolete,

-Detection of usage for family residence permit for purposes outside of the reasons it was given,

-In the case that a verdict of applicant’s deportation or prohibition of entry into the country is found, then family residence permit will not be granted; if already granted will be cancelled, if permit has expired it will not be renewed.

 

Long Term Residence Permit

Long term residence permits have been organised according to the Foreigner ve International Protection Law, number 6458, article 42 and 45. Also, has been organised according to the Foreigner and International Protection Law Reference Guide articles 40 and 43.

Which foreigners can apply for a long term residence permit?

-Those who have continously lived in Turkey for at least eight years or those who have abided by the conditions Migration Policy Committee; with the apporval of the Ministry can be granted a long term residence permit.

-Refugee, or provisory refugree and secondary protected status holders and humanitary residence permit owners and those who are temporarily protected, do have the right to transition to a long term residence permit.

How often does a long term residence permit need to be organised?

Long term residence permits are organised with an indefinate period.

What are the conditions for long term residence permits?

Those applying for long term residence permit must adhere to article 43 of the Foreigners Law.

-Must continuously have lived in Turkey with a residence permit (The eight year period is calculation according to article 38 of the Law: half of the period of stay with a student residence permit and the total period of stay on any other permits),

-In the last three years must not have recieved any social welfare benefits,

-To be able to earn enough income to live off and to earn a regualr salary to take care of oneself, or their family if any,

-To posses valid health insurance,

-Not to be a threat to public order and safety (except for the foreigners that the Immigration Policy Council consider appropriate).

Civil rights of Long term residence permit holders

Those who have a long term residence permit have the same right as Turkish citizens, such as social security; however do not have an obligation to do military service, the right to vote or be elected, to be public servant or exempt from importing vehicles or the civil rights from special statutes.

What are the reasons for denial, cancellation or not extending a long term residence permit?

-Those foreigners who are a threat to public or public safety,

-Those who have stayed outside of Turkey continually for more than one year for reasons other than the purpose of health, education or compulsory public service,

Cancellations of long term residence permits are done by the governership.

The re-application process for foreigners whose long term residence permits have been cancelled

The re-application process for foreigners whose long term residence permits have been cancelled can be done through consulates outside of Turkey, or for those residing in the Turkey they can apply to the governerships of the city they reside in or apply to the Directorate General in person; thus all applications will be assesed according to the determined process.

Requirements for re-applying arethat the applicants have once again continuously stayed in Turkey for at least eight years; these application take priority and will concluded in no more than one month.

For reasons apart from health, education or obligatory public service foreigners who have stayed outside of Turkey for more than one year and thus have had their long term residence permits cancelled may re-apply to have the permit reinstated.

 

Student Residence Permit

Student residence permits have been organised according to the Foreign and International Protection Law, articles 38 and 41. Likewise these permits are organised according to Foreign and International Proetction Law Regulations Guide, articles 35 and 39.

Which foreigners can apply for a student residence permit?

-Foreigner who do not have a family residence permit and are seeking primary and middle school educations (those who have a family residence permit, up until the age of 18, may proceed with with their primary or middle school education without a student residence permit. However those who are 18 yeasrs and over anda re stil in middle school must attain a student residence permit).

-A student residence permit can be organised for foreigners who are in education levels such as; higher education, undergraduate, post graduate, masters, doctorate, specialist medical education (TUS), specialist dentistry (DUS).

Student residence permit allows the permit holder the right to be supporter for family residence permits for only the spouse and child. It does not permit legal rights for any other family member.

How often can student residence permits be organised?

Foreigner students whose education periods are less than one year the student residence permits can not exceed that period.

Those who come to Turkey for education purposes through a public or private agency institution may be given a student residence permit fort he duration of their education.

For foreigners who come for primary or middle school education and whose expenses will be paid by a person or a corporation, must have consent from parents or guardians and permits will be granted for a year at a time.

What are the conditions of student residence permit?

For student residence permits to be organised the content of Foreigners Laws, article 39 must be adhered.

-Reasons for the stay in Turkey must be verified through documentaion (article 38 of the Law)

-Not to be in the scope of article 7 of the Law.

-To advise and regşster address details in Turkey.

Student residence permit health insurance

According to Social Security and General Health Insurance Law, for those foreign student who apply for general health insurance within three months of their education registry further private health inursance will not be required. However for those who have not applied for general health insurance within the three months of registration to their education institue will not be covered by general health insurance and must attain private health insurance.

Procedures for Matters of Alteration for students of Higher Education students of Univeristy, Faculty or other Department

  1. If students change a department or faculty within the same institution or within the same city, without a period of ceasing and subject to notifying the proper government departments, current student residence permits will still be valid.
  2. If students change the city that they reside and study at then they must advise the govership where education will continue in order to attain a new student residence permit for the period required.

Student’s right to employment

Those who are enrolled into formal education; associate degree, under gratudates, post graduate and doctorates, can find employment on the condition that they apply and recieve a work permit. However, those who are in a associates and undergraduates degree can only be entitled work after one year of study.

What are the reasons for rejection, denial, cancellation or non extension of student residence permits?

-Conditions for student residence permit not to be insufficient or to become obsolete,

-Proof that the student will ot be able to mainatin and continue the education,

– The detection that student residence permit is being used for purposes outside of the reasons it was given,

-In the case that a verdict of applicant’s deportation or prohibition of entry into the country is found, then family residence permit will not be granted; if already granted will be cancelled, if permit has expired it will not be renewed.

 

Humanitarian Residence Permits

Humanitary residence permits are organised according to Foreign and International Protection Law, article 46 and 47. Likewise these permits are organised according to Foreign and International Proetction Law Regulations Guide, article 44.

For which foreigners can humanitary residence permits be organised for?

-When it is in the best interest and high benefit of the child,

-For foreigners who are subject to deportation, or entry into Turkey has been court prohibited, or when exiting Turkey has not been enforced or if exiting Turkey is not advisable or possible,

-Persuant to Law number 55; foreigners who do ot have a deportation requirement,

-Persuant to Law number 53, articles 72 and 77, when a judicial processed has been made,

-If the applicant’s first and third choice of country for asylum status applicantion is stil in active process,

-In the event of an emergency: if the foreigner is seen fit; taking into consideration the country’s best interest in regards to public order and safety and so long as the foreigner does not impose any threat to the country and that there are no other obstacle for granting a residence permit; the granting of other residence permits are possible.

Humanitary residence permits can be organised.

How often do Humanitary residence permits need to be organised?

Humanitray residence permits can be no longer than a period of one year and with the approval of the Ministry can be attained and extended at the office of the governership.

What are the conditions of humanitary residence permit?

Though other permits have conditions that are required to be meet the humanitary residence permit do not.

What are the reasons for denial, cancellation or not extending a humanitary residence permit?

If the purpose of the grant for humanitary residence permits become obsolete, the with the approval of the Ministry it will be cancelled or not extended.

Other matters in regards to humanitary residence permits

Foreigners who have been granted a humanitary residence permit must, within and no later than twenty one days, inform and register their address details to the relevant department.

Those who hold a humanitary residence permit, within the permit’s period, apply for other residence permits except for a long term residence permit.

The anticipated time period, by law, will be added to the calculation of the total time period for the validity period of the humanitary residence permit.
